Petition Filed in Supreme Court Challenging Constitutionality of November 14 Parliamentary Election

A petition has been submitted to the Supreme Court, contesting the constitutionality of the scheduled parliamentary election on November 14.

The petition was filed by H. M. Priyantha Herath, the convener of the “Api Sri Lanka Jathika” (We Sri Lanka National Organization). Named as respondents in the case are the Attorney General, the Secretary to the President, the Chairman of the Election Commission, and other Election Commission members.

In the petition, Herath points out that nominations for the parliamentary election were accepted from October 4 to October 11. According to the Elections Act, the date for the election must be set at least five weeks and no more than seven weeks after the closure of nominations. This means the five-week deadline from October 11 ends on November 15, while the seven-week deadline extends to November 29.

Herath argues that holding the parliamentary election on November 14 falls outside the legally mandated timeframe, making it unlawful. Despite attempts to notify the Chairman of the Election Commission about this issue, the petitioner claims there has been no resolution.

Consequently, the petitioner is requesting that the Supreme Court declare that the Constitution is being violated and issue appropriate orders to rectify the situation.
