The President of the Court of Appeal announced today (31) that one of the five-judge bench hearing the petition filed by former President Maithripala Sirisena requesting the issuance of a writ to quash a private complaint filed against him before the Fort Magistrate’s Court has given notice that one of the judges will withdraw. That petition was heard today by the President of the Court of Appeal, Judge Nishanka Bandula Karunaratne and A. was called before the Bench consisting of Messrs. Marikkar.
At that time, the presiding judge, Mr. Nishanka Bandula Karunaratne, informed that Mr. Neil Iddawela, a member of the five-member bench appointed to hear this petition, has informed that he will withdraw from this case.
Accordingly, for the relevant vacancy, the presiding judge announced Court of Appeal Judge D. N. Samarakoon will be nominated.
Accordingly, the relevant petition was filed by Nishanka Bandula Karunaratne, Sobitha Rajakaruna, Menaka Wijesundara, Dhammika Ganepola and Dates were set for the hearing before the five-member Court of Appeal bench of D. N. Samarakoon on October 16, 17, 18 and 20.
Father Cyril Gamini and two others had filed a private complaint before the Fort Magistrate’s Court against the former President Maithripala Sirisena on the charges of criminal murder and other charges of criminal homicide despite receiving intelligence information that a terrorist attack was about to take place on Easter Sunday.
The Fort Magistrate, who considered the complaint, issued a summons to the respondent Mr. Maithripala Sirisena to appear before the court.
Mr. Maithripala Sirisena has also requested the Court of Appeal to issue a writ ruling that the summons is illegal and invalidate the related personal complaint.
