The Supreme Court ordered the immediate restoration of Air Marshal Sampath Thuiyakonta, who was denied post-retirement privileges due to his involvement in JJB meetings I Sri Lanka Latest News

 Yesterday (7), the Supreme Court ordered the Attorney General and the respondent party to immediately restore the relevant privileges of retired Air Marshal Sampath Thuiyakonta, who was deprived of his post-retirement privileges due to his participation in National People’s Force political meetings. The judges have ordered to give a letter to the petitioner Mr. Sampath Tuiyakontha and the lawyer who represented him, stating that the privileges granted will be restored.

Retired Air Vice Marshal Sampath Tuiyakonta requesting that the decision of the Chief of the Air Force to blacklist him by depriving him of his Air Force pension privileges due to his participation in several meetings of the National People’s Force and to give an order to collect a bribe of 5 million rupees from him for the violation of his fundamental rights. That fundamental rights case had been filed.

In addition to the Air Force Commander, the Director of Air Force Administration, State Defense Minister Pramitha Bandara Tennakon Bha and the Attorney General have filed this petition as respondents. Retired Air Vice Marshal Sampath Tuiyakontha has pointed out in the complaint that he came to know through the media last March that he had been blacklisted by the Air Force for abusing his retired privileges, but the Air Force has not yet informed him in this regard.

The complaint also mentions that State Security Minister Pramitha Bandara Tennakoon said in Parliament that she had to be blacklisted as a result of expressing her opinion on the National People’s Force political platform.

He says that for more than 30 years, he has done a great job as a pilot to end the war in this country and that he has won many medals such as heroism, heroism and warriorship.

Retired Air Vice Marshal Sampath Thuiyakontha says that he has not been involved in any illegal activities while serving in the Air Force or after retiring from the Air Force. In such a situation, it is stated in the complaint that he has submitted that blacklisting himself by depriving the Air Force of retirement privileges is a very problematic situation.

Mr. Sampath Thuiyakontha has said in his complaint that the Air Force Commander or his representative authorities do not have the authority to blacklist a retired officer without following the standard legal procedures.

In his petition, Mr. Sampath Tuiyakontha has requested the Supreme Court to annul the decision taken by the Air Force Commander and to recover a compensation of 5 million rupees from the Air Force Commander for depriving him of his basic rights, as blacklisting him without any inquiry is a violation of his fundamental rights.

Lawyer Sunil Vatagala and J.M. Lawyers Vijaya Bandara have represented the petitioner Mr. Sampath Thuiyakontha.
