Gotabaya Rajapaksa’s Petition Taken Up Today: One Judge Recuses, No Instructions from Respondents, Hearing Adjourned Till Afternoon

The Attorney General informed the Court of Appeal today (17) that he has not yet received instructions from the respondents regarding the petition filed by former President Gotabaya Rajapaksa, which seeks an order preventing his arrest in connection with investigations into the Easter Sunday terror attacks. The petition was taken up before a bench of the Court of Appeal comprising the Chairman of the Appeals Division, Justice Rohantha Abeysuriya, and Justice Priyantha Fernando.

At the commencement of proceedings, Justice Priyantha Fernando stated that he would not be participating in the hearing due to personal reasons.

President’s Counsel Romesh de Silva, appearing on behalf of the petitioner Gotabaya Rajapaksa, requested the court to issue an interim injunction preventing the arrest of his client.

However, Deputy Solicitor General Suharshi Herath, appearing for the respondents, informed the court that she had received the relevant documents only this morning and had not yet received any instructions from the respondents.

She further submitted that the court cannot provide an undertaking that the petitioner will not be arrested without obtaining instructions from the respondents.

Subsequently, the Court adjourned the hearing until this afternoon.
