Court of Appeal to Review Petition Challenging Jaffna MP Ramanathan Archuna’s Parliamentary Eligibility

The Court of Appeal today ordered the consideration of a petition seeking a writ of certiorari to nullify the parliamentary seat of Jaffna District Independent Group MP, Ramanathan Archuna.

The petition was filed by Oshala Herath, Chairman of the Abhinava Niwahal Peramuna, and was taken up before the Court of Appeal Bench comprising Justices Sobitha Rajakaruna and Mahen Gopallawa. The court ordered the petition to be heard on January 15th to confirm the relevant facts.

The petitioner alleges that MP Ramanathan Archuna submitted his nomination for the last general election while serving as a government doctor. He argues that submitting nominations without resigning from government service is illegal and violates the provisions of the Elections Act. The petition further requests the court to declare that MP Archuna is disqualified from holding a parliamentary seat under the Constitution and to invalidate his appointment.
