The Court of Appeal has set a date to consider the revision petition submitted by the Samagi Janabalawega seeking a decision suspending the injunction issued by the Colombo District Court preventing Field Marshal Sarath Fonseka’s party membership and his removal from the positions he holds. When the petition was called today (06), Court of Appeal Judge D. N. Mr. Samarakoon ordered to convene on the 21st of this month to consider the petition.
The revision petition has been submitted by a group including Samagi Jana Balawega leader Sajith Premadasa and General Secretary Ranjith Madduma Bandara.
The Colombo District Court heard a case filed by Mr. Sarath Fonseka that the leaders of the Samagi Jana Balavega are preparing to remove him from his party membership and the positions he holds in the party after his statements regarding the joining of a former army commander, Daya Ratnayake, to the Samagi Jana Balavega. An injunction had been issued preventing the eviction.
The Colombo District Court also rejected a request made by Sajith Premadasa, the leader of the Samagi Jana Balavegaya, to lift the injunction order.
This revision petition has been submitted requesting that the decision of the Colombo District Court is against the law and accordingly the related decision be revised and an order be issued suspending the injunctions obtained by Mr. Sarath Fonseka.
