CA says no action on Sirisens’s case for 10 weeks

The Court of Appeal of Sri Lanka has ordered the Fort Magistrate’s Court to stay any action in the lawsuit filed against Former President Maithripala Sirisena in connection with the 2019 Easter Sunday terror attacks for a period of ten weeks beginning Friday (14).

The Fort Magistrate’s Court had already summoned Sirisena to appear in court on Friday (14) in relation to the case.

Following that, the former president filed a writ application with the Court of Appeal, requesting that the summons be quashed.

Sobitha Rajakaruna and Dhammika Ganepola of the Court of Appeal ruled that the debate on the application be held on December 6, 2022.

Furthermore, an order was issued for written submissions to be filed by November 30th, 2022.

However, the interim injunction sought by Maithripala Sirisena to quash the Fort Magistrate’s Court summons was not issued on Friday (13).

The Court of Appeal has scheduled an order on whether it will impose a Stay Order in response to a writ case filed by former President Maithripala Sirisena for October 14 (tomorrow).

This is in relation to a personal complaint filed on the inability to prevent the terrorist attack on Easter Sunday, April 21, 2019, despite intelligence knowledge.

The petition was heard before a Court of Appeal bench comprised of Justices Sobitha Rajakaruna and Dhammika Ganepola.

Rev. Father Cyril Gamini and Jesudasan Nadesan, who was hurt in the attack, sued former President Maithripala Sirisena in the Fort Magistrate’s Court for not being able to stop the terrorist attack on Easter Sunday, 2019.
