The Supreme Court has ordered Army Commander Vikum Liyanage to execute the mandamus order given by the Court of Appeal regarding Brigadier Chandana Ranaweera of the Army Infantry Regiment. Sri Lanka Latest News
It was on February 01 that the decision was given regarding the 4/24 special petition submitted by the Army Commander to the Supreme Court challenging the decision given in the petition filed by Brigadier Chandana Ranaweera in the Court of Appeal against the injustice done to him.
The Court of Appeal had in its judgment ordered that Brigadier Chandana Ranavira be recommended to the President for promotion to the rank of Major General with effect from January 01, 2021, thereby establishing his seniority. To give him the command of the infantry regiment according to his seniority, to appoint him to a suitable position in the army according to his seniority, and to give him his due salaries, allowances and privileges.
The Supreme Court decision has been given by the Supreme Court judges Yasanta Kodagoda and Mahinda Samayawardena Priyantha Fernando and the appeal court order has been notified to be implemented from that day.
The Court of Appeal had given its verdict on Brigadier Chandana Ranaweera’s petition on November 23, 2023, and despite receiving instructions from the Attorney General and the Chief of Army Staff not to appeal it, the Army Commander had submitted the appeal based on his sole opinion.
