The Bar Association of Sri Lanka has written to President Anura Kumara Dissanayake regarding a proposed move to increase the retirement age of judges in the judiciary, including those serving in the Court of Appeal and the Supreme Court. Sri Lanka Latest News
In its letter, the Bar Association emphasizes that the public is likely to perceive an increase in the retirement age of currently serving judges as a clear attempt to undermine the independence of the judiciary.
It further states that implementing such a measure without a long-term plan could damage both the reputation of the courts and the judges serving within them.
The Bar Association also warns that if the current government proceeds with such a step, it may set a dangerous precedent for future governments to introduce constitutional amendments relating to judicial functions without proper long-term planning.
The letter highlights that the independence of the judiciary and public confidence in it are essential pillars of the rule of law and the democratic framework of the Republic. It further stresses that it is of utmost importance that the judiciary is not only independent in principle, but also completely independent, impartial, and free from even the slightest influence, favoritism, or impropriety.
Accordingly, the Bar Association of Sri Lanka, in fulfilling its responsibility to protect the rule of law and judicial independence, has expressed strong concern over the proposed amendment, stating that it is not in the interests of the judiciary or the public.
In this context, the Bar Association has requested the President not to proceed with any proposed constitutional amendment to increase the retirement age of judges in the judiciary, including those in the Court of Appeal and the Supreme Court.
The letter also expresses confidence that the President will give due consideration to the importance of safeguarding the independence, integrity, dignity, and public trust of the judiciary, which are essential for maintaining the rule of law and democratic governance in Sri Lanka.
