CID has the legal authority to arrest Diana if immigration and emigration regulations are broken; a court order is not required – Colombo Chief Magistrate

Colombo Chief Magistrate Mr. Prasanna Alwis ordered that the Court will not issue an order in relation to the arrest of State Minister Diana Gamage for offenses under the Immigration and Emigration Act as the Criminal Investigation Department has the power to take necessary measures.

Earlier in the case, the plaintiff Oshala Herath and the aggrieved party’s lawyers had made a request before the court and pointed out that the Criminal Investigation Department will not proceed to arrest Diana Gamage despite the fact that sufficient evidence has been presented.

Therefore, the lawyers had previously asked the court to issue an order for the arrest of Diana Gamage according to the powers assigned to the court under section 32 of the Criminal Procedure Code.

Announcing its decision today, the magistrate stated that the investigating officers have the authority under the Criminal Procedure Code to deal with it.

Therefore, the magistrate said that it is unnecessary for his court to issue an order in this regard.

After that, the magistrate ordered the case to be shelved without a date.
