Fort Magistrate Thilina Gamage ordered today (27) to recall the case related to the personal complaint filed before the Colombo Fort Magistrate Court against former President Maithripala Sirisena for not taking steps to prevent the Easter attack.

When the case related to this incident was called before the open court, the suspect, Mr. Maithripala Sirisena, did not stand in the dock, and Mr. Rienzi Arsakularatne, who represented the plaintiff, expressed his objection.

President’s Counsel Mr. Faizer Mustapha, who appeared in court for the suspect Mr. Maithripala Sirisena, mentioned that
As the Court of Appeal has suspended further action regarding the personal case assigned against his client, he need not enter the dock.

Here, the Magistrate mentioned that the Court of Appeal has ordered his court to read the charge sheet to the suspect and stop further proceedings in the case until the Court of Appeal gives an order, not an order for the suspect not to go to the dock.

Later, the magistrate ordered the court interpreter to call out the name of the suspect in that case.

Accordingly, after the court interpreter called the suspect Mr. Maithripala Sirisena’s name in a loud voice, the suspect entered the dock.

The Magistrate strongly warned the suspect that whenever this case is called again in the future, the suspect should go to the dock where he should be.

This personal complaint was submitted to the court by Mr. Yesuraj Ganesan and Father Cyril Gamini who lost a leg in the terrorist attack on Easter Sunday.
